GENERAL TERMS AND CONDITIONS FOR THE HYTECON ONLINE SHOP

1. Scope
These General Terms and Conditions (in the current version; hereinafter «GTC») are an integral part of all contracts between a customer, which are made via the platform [www.hytecon.com] («Hytecon online shop») buy articles («customer») and Hytecon AG (as the owner and operator of the Hytecon online shop) («Hytecon»).

2. Conclusion of contract
2.1. Contractual partner
When ordering items via the Hytecon online shop, the customer's contractual partner is HYTECON AG, Brunnhalde 10, 6006 Lucerne, Switzerland.
2.2. Binding nature of prices
Our information on goods and prices within the ordering process is subject to change and non-binding.
2.3. Acceptance
By clicking the "buy now" button, you place a binding order for the items in the shopping cart. We will confirm the receipt of your order immediately by email after sending the order. A binding contract comes about upon receipt of the order confirmation.
2.4. Changes
Changes to the contract or the General Terms and Conditions must be made in writing; any general terms and conditions of the customer do not apply.

3. Prices and shipping costs
3.1. Prices
The prices listed in the offer at the time of the order apply. The prices quoted are final prices, which means they include the applicable statutory value added tax and are in euros (€).
3.2. Shipping costs
The shipping costs to the customer are included within the European Union. Shipping costs are only invoiced separately outside of the EU. You can see the costs involved during the ordering process. In the event of a possible revocation, the costs will be borne by the customer.

4. Payment
4.1. Means of payment
Hytecon basically offers the payment methods credit card, Klarna and PayPal. With every order, Hytecon reserves the right not to offer certain payment methods and to refer to other payment methods. Please note that we only accept payments from accounts in Switzerland and within the European Union (EU). Any costs of a money transaction are to be borne by the customer. Checks are not accepted.
4.2. Retention of title
The delivered goods remain the property of Hytecon until full payment has been made.

The customer agrees that he receives invoices and reminders in electronic or paper form.

5. Delivery of goods
Hytecon is not obliged to procure ordered goods (Hytecon does not assume the procurement risk). Hytecon is only obliged to deliver items from its inventory.

6. Warranty/guarantee/right of return
6.1. Warranty / Guarantee
The period for asserting warranty claims is 2 years and begins with the delivery of the goods to the buyer. During this period, all defects that are subject to the warranty will be remedied free of charge or the goods will be replaced with goods free of defects. The warranty claims are limited to replacement delivery or rectification of defects to the exclusion of all other claims, in particular for direct and indirect damage, consequential damage, direct and indirect damage and loss of profit. Hytecon decides at its own discretion whether to deliver a replacement or rectify the defect.The warranty claim does not exist for defects resulting from improper handling and use of the purchased item (see operating instructions)
6.2. Customer's right of return
For all purchases in the Hytecon online shop, Hytecon grants you a right of return of a total of 14 days from receipt of the goods. You can withdraw from the contract within this period by sending the goods back to Hytecon (period begins on the day after receipt of the goods). Timely dispatch is sufficient to meet the deadline. However, a prerequisite for exercising the right of return is that you return the goods complete, unused and undamaged. In addition, the goods must be returned in the original packaging and the cancellation form must be enclosed.
6.3. Repayments
We will automatically initiate any repayments to the account you used for payment. If you paid by PayPal or credit card, the refund will be made to the associated PayPal or credit card account.

7. Data protection

8. Copyright and trademark protection
Hytecon or its partners hold all copyrights or trademark rights to the images, graphics, texts etc. used. Use without express consent is not permitted.

9. Final Provisions
9.1. Invalid Clauses
Should individual provisions of the contract or these General Terms and Conditions be or become void, ineffective or unenforceable, the remaining part of the contract or the General Terms and Conditions shall not be affected thereby. In the event that a provision is void, ineffective or unenforceable, it must be replaced by a new provision, the purpose of which is

originally intended purpose of the void, ineffective or unenforceable provision. Proceed in the same way if a gap becomes apparent.
9.2. Applicable law and place of jurisdiction
The entire contractual relationship between the customer and Hytecon (in particular all sales contracts concluded via the online shop) are exclusively subject to substantive Swiss law (the UN sales law CISG and any other international agreements do not apply). The parties agree on Lucerne, Switzerland as the exclusive place of jurisdiction.
